Justice Verma Committee Report Summary


Background: On December 23, 2012 a three member Committee headed by Justice J.S. Verma, former Chief Justice of the Supreme Court, was constituted to recommend amendments to the Criminal Law so as to provide for quicker trial and enhanced punishment for criminals accused of committing sexual assault against women.  The other members on the Committee were Justice Leila Seth, former judge of the High Court and Gopal Subramanium, former Solicitor General of India.  

The Committee submitted its report on January 23, 2013.  It made recommendations on laws related to rape, sexual harassment, trafficking, child sexual abuse, medical examination of victims, police, electoral and educational reforms.  We summarise the key recommendations of the Committee.

Rape:
 The Committee recommended that the gradation of sexual offences should be retained in the Indian Penal Code, 1860 (IPC).  

The Committee was of the view that rape and sexual assault are not merely crimes of passion but an expression of power.  Rape should be retained as a separate offence and it should not be limited to penetration of the vagina, mouth or anus.  Any non-consensual penetration of a sexual nature should be included in the definition of rape.  

The IPC differentiates between rape within marriage and outside marriage.  Under the IPC sexual intercourse without consent is prohibited.  However, an exception to the offence of rape exists in relation to un-consented sexual intercourse by a husband upon a wife.  The Committee recommended that the exception to marital rape should be removed.  Marriage should not be considered as an irrevocable consent to sexual acts.  Therefore, with regard to an inquiry about whether the complainant consented to the sexual activity, the relationship between the victim and the accused should not be relevant.  


Sexual assault:  Currently, “assault or use of criminal force to a woman with the intent to outrage her modesty” is punishable under Section 354 of the IPC with 2 years imprisonment.  The term outraging the modesty of a woman is not defined in the IPC.  Thus, where penetration cannot be proved, the offence is categorized as defined under Section 354 of the IPC. 

The Committee recommended that non-penetrative forms of sexual contact should be regarded as sexual assault.  The offence of sexual assault should be defined so as to include all forms of non-consensual non-penetrative touching of a sexual nature.  The sexual nature of an act should be determined on the basis of the circumstances.  Sexual gratification as a motive for the act should not be prerequisite for proving the offence.  The offence should be punishable with 5 years of imprisonment, or fine, or both.

Use of criminal force to disrobe a woman should be punishable with 3 to 7 years of imprisonment. 

Verbal sexual assault: At present, use of words or gestures to “insult a woman’s modesty” is punishable with 1 year of imprisonment or fine or both under Section 509 of the IPC.  This section should be repealed.  The Committee has suggested that use of words, acts or gestures that create an unwelcome threat of a sexual nature should be termed as sexual assault and be punishable for 1 year imprisonment or fine or both.    


Sexual harassment: Some of the key recommendations made by the Committee on the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Bill, 2012 that is pending in Parliament are provided below:
  • Domestic workers should be included within the purview of the Bill. 
  • Under the Bill the complainant and the respondent are first required to attempt conciliation.  This is contrary to the Supreme Court judgment in Vishakha vs. State of Rajasthan which aimed to secure a safe workplace to women. 
  • The employer should pay compensation to the woman who has suffered sexual harassment.
  • The Bill requires the employer to institute an internal complaints committee to which complaints must be filed.  Such an internal committee defeats the purpose of the Bill and instead, there should be an Employment Tribunal to receive and adjudicate all complaints.
Acid attack:  The Committee opined that the offence should not be clubbed under the provisions of grievous hurt which is punishable with 7 years imprisonment under the IPC. It noted that the offence was addressed in the Criminal Laws Amendment Bill, 2012 which is currently pending in Parliament.  The Bill prescribes a punishment of imprisonment for 10 years or life.  It recommended that the central and state government create a corpus to compensate victims of crimes against women.  

Offences against women in conflict areas:  The continuance of Armed Forces (Special Powers) Act (AFSPA) in conflict areas needs to be revisited.  At present, the AFSPA requires a sanction by the central government for initiating prosecution against armed forces personnel.  The Committee has recommended that the requirement of sanction for prosecution of armed forces personnel should be specifically excluded when a sexual offence is alleged.  Complainants of sexual violence must be afforded witness protection.  Special commissioners should be appointed in conflict areas to monitor and prosecute for sexual offences.  Training of armed personnel should be reoriented to emphasise strict observance of orders in this regard by armed personnel. 

Trafficking:
  The Committee noted that the Immoral Trafficking Prevention Act, 1956 did not define trafficking comprehensively since it only criminalised trafficking for the purpose of prostitution.  It recommended that the provisions of the IPC on slavery be amended to criminalise trafficking by threat, force or inducement.  It also recommended criminalising employment of a trafficked person.  The juvenile and women protective homes should be placed under the legal guardianship of High Courts and steps should be taken to reintegrate the victims into society.

Child sexual abuse:
 The Committee has recommended that the terms ‘harm’ and ‘health’ be defined under the Juvenile Justice Act, 2000 to include mental and physical harm and health, respectively, of the juvenile.  


         

Punishment for crimes against women: The Committee rejected the proposal for chemical castration as it fails to treat the social foundations of rape.  It opined that death penalty should not be awarded for the offence of rape as there was considerable evidence that death penalty was not a deterrence to serious crimes.  It recommended life imprisonment for rape.

Medical examination of a rape victim: The Committee has recommended the discontinuation of the two-finger test which is conducted to determine the laxity of the vaginal muscles.  The Supreme Court has through various judgments held that the two-finger test must not be conducted and that the previous sexual experience of the victim should not be relied upon for determining the consent or quality of consent given by the victim.      

Police reforms: The Committee has recommended certain steps to reform the police.  These include establishment of State Security Commissions to ensure that state governments do not exercise influence on the state police.  Such Commissions should be headed by the Chief Minister or the Home Minister of the state.  The Commission would lay down broad policy guidelines so that the Police acts according to the law.  A Police Establishment Board should be established to decide all transfers, postings and promotions of officers.  Director General of Police and Inspector General of Police should have a minimum tenure of 2 years. 




Reforms in management of cases related to crime against women:  
  • A Rape Crisis Cell should be set up.  The Cell should be immediately notified when an FIR in relation to sexual assault is made.  The Cell must provide legal assistance to the victim. 
  • All police stations should have CCTVs at the entrance and in the questioning room. 
  • A complainant should be able to file FIRs online. 
  • Police officers should be duty bound to assist victims of sexual offences irrespective of the crime’s jurisdiction. 
  • Members of the public who help the victims should not be treated as wrong doers. 
  • The police should be trained to deal with sexual offences appropriately.
  • Number of police personnel should be increased.  Community policing should be developed by providing training to volunteers.

Electoral reforms: 
The Committee recommended the amendment of the Representation of People Act, 1951.  Currently, the Act provides for disqualification of candidates for crimes related to terrorism, untouchability, secularism, fairness of elections, sati and dowry.  The Committee was of the opinion that filing of charge sheet and cognizance by the Court was sufficient for disqualification of a candidate under the Act.  It further recommended that candidates should be disqualified for committing sexual offences.  

Education reforms:  The Committee has recommended that children’s experiences should not be gendered.  It has recommended that sexuality education should be imparted to children.  Adult literacy programs are necessary for gender empowerment.

दिल्ली के पहले ही apocalyptic हवा ने मंगलवार को बदतर के लिए एक मोड़ ले लिया, सुप्रीम कोर्ट में नियुक्त पर्यावरण प्रदूषण नियंत्रण प्राधिकरण (EPCA) ने कहा कि यह राजधानी में निजी वाहनों की चलाने रोक सकता है सब एक साथ अगर हवा की गुणवत्ता में और अधिक खराब ।

EPCA के चेयरमैन भुरे लाल ने कहा, ' हमें उम्मीद है कि दिल्ली में वायु प्रदूषण की स्थिति न बिगड़े वरना हमें निजी वाहनों की चलाने बंद करनी पड़ेगी । केवल सार्वजनिक परिवहन का उपयोग किया जाएगा.
कुल मिलाकर वायु गुणवत्ता सूचकांक (AQI) 3 बजे ४०१ था, ' गंभीर ' श्रेणी में गिरने, सबसे अधिक इस मौसम-कि जब अंयथा स्वस्थ व्यक्तियों को गरीब हवा से नुकसान हो रही शुरू करते हैं ।

स्थिति के रूप में क्लस्टर सेवाओं में गंभीर है, दिल्ली एकीकृत मल्टी मोडल ट्रांजिट सिस्टम (DIMTS) द्वारा प्रबंधित के रूप में ४० अपने १४७ मार्गों के बस एक से पांच बसों प्रत्येक द्वारा सेवा कर रहे हैं । साथ में वे दिल्ली मेट्रो की तुलना में ज्यादा ट्रिप लेते हैं ।

सीधे शब्दों में कहें तो राजधानी की सार्वजनिक परिवहन व्यवस्था पंगु हो गई है.

लेकिन अब तक पंजाब और हरियाणा में पिछले सालों की तुलना में फसल जलती कम हुई है । नासा के आंकड़ों के अनुसार, वहां आग के १५,८८६ उदाहरण दिया गया है-पिछले चार वर्षों में सबसे कम और ४३% आग की संख्या से भी कम के आसपास पिछले साल इसी अवधि के दौरान पता चला (२७,९९६) । "लेकिन यह आने वाले सप्ताह में बदल सकता है और हमें डर है कि मौजूदा प्रदूषक मामलों बदतर बना सकता है," CPCB के एक अधिकारी ने कहा ।

लेकिन चाहे, वाहनों प्रदूषण प्रमुख रहता है-न सिर्फ अक्टूबर और नवंबर के महीनों के दौरान, लेकिन साल भर ।

पृथ्वी विज्ञान मंत्रालय के तहत वायु गुणवत्ता और मौसम की भविष्यवाणी और अनुसंधान (सफ़र) की प्रणाली के द्वारा एक अध्ययन में पाया गया भारी वाणिज्यिक वाहनों और निजी स्वामित्व वाले वाहनों के बीच प्रदूषण के लिए प्रधानमंत्री के योगदानकर्ताओं के बीच थे, सूत्रों के बीच एक 25-४५ प्रतिशत शेयर के साथ ।

अब तक दिए गए दिशा-निर्देश

राज्य सरकार और EPCA ने पहले ही प्रदूषण की जांच के लिए कई उपाय लागू किए हैं, जिसमें नवंबर से दिल्ली-एनसीआर में निर्माण गतिविधियों को रोक लगाने सहित 1-10 स्टोन क्रशर और डस्ट प्रदूषण उत्पन्न करने वाले हॉट मिक्स प्लांट भी रहेंगे 10 दिन के लिए बंद कर दिया । ईंधन के रूप में कोयला और बायोमास का उपयोग करने वाले उद्योग (ऊर्जा संयंत्रों को थर्मल और अपशिष्ट को छोड़कर) 4-10 नवंबर से दिल्ली-एनसीआर में भी बंद रहेंगे ।

इसके अलावा प्रशासन ने प्रदूषण फैलाने वाले वाहनों की चेकिंग तेज कर दी है और डीजल gensets की आवश्यकता से बचने के लिए एनसीआर में बिजली आपूर्ति बाधित करने के लिए प्रयास किए हैं ।

लोकतंत्र में चुनावी जागरूपता जरूरी है| परिपक़्व लोकतंत्र




 आपराधिक मामलों में फंसे नेताओं के चुनाव लड़ने पर फैसला देते हुए सुप्रीम कोर्ट ने इसे संसद के विवेक पर छोड़ दिया है. अब समस्या यह है कि क्या संसद खुद कोई ऐसा कानून बनायेगी, जिससे कि संसद को दागदार छवि वाले नेताओं से मुक्त बनाया जा सके? क्योंकि, आज एक भी ऐसी पार्टी नहीं है, जिसमें ऐसे नेता न हों, जिनके खिलाफ कोई गंभीर आपराधिक मामले न हो. इस फैसले के मद्देनजर कुछ बातें अहम हैं, जिन्हें समझना जरूरी है. पहली बात तो यह है कि ‘पीपुल्स रिप्रजेंटेशन एक्ट’ में चुनाव लड़ने के लिए क्वालिफिकेशन और डिसक्वालिफिकेशन, दोनों से संबंधित प्रावधान हैं.

लिली थामस के एक फैसले में यह बात कही गयी थी कि जब किसी व्यक्ति पर आरोप साबित हो जाये, तो वह चुनाव नहीं लड़ सकेगा. यह अरसा पहले की बात है. यही वजह है कि चारा मामले में फंसे लालू प्रसाद यादव को चुनाव लड़ने से वंचित कर दिया गया था.

अब सुप्रीम कोर्ट का यह कहना है कि संसद को कानून बनाना चाहिए, ताकि राजनीति में अपराधी व्यक्तियों का आगमन न होने पाये. लेकिन, अगर कानून बना देने से राजनीतिक या चुनावी प्रक्रिया साफ हो जाती, तो यह राजनीति बहुत पहले स्वच्छ हो गयी होती.

एक कानून तो है ही कि संसदीय चुनाव में एक प्रत्याशी 75 लाख रुपये खर्च कर सकता है, लेकिन इससे कहीं ज्यादा ही खर्च होता है. इससे यह बात साफ है कि सिर्फ कानून बना देने से किसी समस्या का हल नहीं हो सकता है. कानून तो यह भी कहता है कि आदमी तब तक निर्दोष होता है, जब तक उस पर अपराध सिद्ध न हो जाये और जब तक वह निर्दोष है, तब तक तो वह चुनाव लड़ ही सकता है.

ऐसे में यही लगता है कि अगर संसद कोई ऐसा कानून बनाती भी है, जिसमें किसी पर कोई आरोप होने पर वह चुनाव लड़ने से वंचित हो सकता है, तो इससे होगा यह कि चुनाव से पहले ही दूसरी पार्टियों के प्रत्याशियों पर कोई नेता केस करके उसे फंसा सकता है, ताकि वे चुनाव न लड़ सकें. यही बुनियादी दिक्कत है, जिसे समझने की जरूरत है.
अगर हमें अपनी राजनीति में अच्छे लोगों को लाना है, तो सिर्फ कानून बनाना ही काफी नहीं है. ऐसी बहुत-सी बुनियादी बातें हैं, जिन्हें समझने की जरूरत है. सबसे पहले हमें चुनाव सुधार के बारे में सोचना होगा और देखना होगा कि हम किस तरह से चुनावी सुधार करें, जिससे कि उसमें कोई लूप होल न नजर आये.
जब तक चुनाव में मनी-मसल (पैसा और पावर) का मसला बना रहेगा, तब तक चुनाव सुधार हो ही नहीं सकता. जिस दिन मनी-मसल का मसला खत्म हो जायेगा, उस दिन एक ईमानदार व्यक्ति भी चुनाव लड़ सकेगा और वह दिन हमारे लोकतंत्र के लिए बहुत ही शुभ होगा.

देश की जनता अपने नेताओं को इसलिए वोट देती है, ताकि वे नेता उनके लिए काम कर सकें. यानी सड़क-बिजली-पानी से लेकर तमाम जमीनी कामों और जरूरतों को जनता तक मुहैया करा सकें. यही सबसे बड़ी समस्या है जागरूकता न होने की. हमें यह बात समझनी होगी कि हमारे जनप्रतिनिधियों का काम जनता का प्रतिनिधित्व करना तो है, लेकिन अच्छे कानून लाकर और संसद एवं विधानसभाओं में बजट पास करके ही प्रतिनिधित्व करना है.

संसद सदस्यों या विधानसभा सदस्यों का काम जमीनी काम करवाना नहीं है, बल्कि यह काम सरकार का है. हां, उस सरकार में भले कुछ जनप्रतिनिधि हो सकते हैं. जनता जिस दिन यह बात समझ जायेगी, उस दिन वह वोट बैंक नहीं बनेगी और न ही वह किसी बाहुबली को वोट देगी. इस जागरूकता से ही जनता द्वारा विधायकों या सांसदों के चुनाव में बदलाव आयेगा.

फिलहाल जो चुनावी प्रक्रिया है, उसमें सिर्फ क्वालिफिकेशन या डिसक्वालिफिकेशन से काम नहीं चलेगा. इस प्रक्रिया को इको-कैंपेन बनाना होगा.
मसलन कि प्रचार-प्रसार का तरीका ठीक करना होगा. दूसरी बात यह कि लोगों को यह बताया जाना चाहिए कि वे लोगों को चुनते ही क्यों हैं? वहीं, पार्टियों पर भी यह दबाव होना चाहिए कि वे खराब छवि के लोगों को टिकट ही न दें.हमारी शिक्षा प्रणाली यह नहीं सिखाती है कि हम संसद और विधानसभा सदस्यों को क्यों चुनते हैं. यह जागरूकता का विषय है. सिर्फ यही प्रचार किया जाता है कि वोट देना जनता का अधिकार है और जनता को लगता है कि उसका अधिकार यही है कि वह पांच साल में सिर्फ एक दिन या एक बार वोट दे दे.

इसलिए उस वक्त उसे जो ठीक लगता है, उसे वोट देकर पांच साल के लिए चुप हो जाती है. जनता को यह सोचना चाहिए कि वह उन लोगों को चुनकर भेजे, जो उनका नेतृत्व कर सकें. जनता को हमेशा यह सोचना चाहिए कि वह अपने प्रतिनिधि से पूछे कि वह देश का नेतृत्व कैसे कर रहा है. सिर्फ अपना काम कराने के लिए जनता को अपने प्रतिनिधि के पास नहीं जाना चाहिए.

बीते दो दशक में हमारी चुनावी प्रक्रिया में काफी सारे बदलाव आये हैं. साल 2000 के शुरू में सुप्रीम कोर्ट ने यह कहा था कि चुनाव लड़ने जानेवाले प्रत्याशियों को यह बताना होगा कि उस पर कोई केस तो नहीं चल रहा है, अगर चल रहा है, तो उस पर कार्रवाई हो रही है या नहीं. अब हमें यह देखना है कि इस प्रक्रिया को हम आगे कैसे सुधार के तौर पर ले आते हैं. यानी चुनाव के पूरे इको-सिस्टम को सुधारना होगा, ताकि जनप्रतिनिधियों की गुणवत्ता बेहतर हो सके|

In the sense of the connectivity the place is well located. Metro and bus connectivity is best at this place. You will have to take metro for ‘G. T. Bmetrostation’ (which is on Yellow line) and exit from gate number 2. At that exit only you will find number of autos and e rickshaw to the Mukherjee nagar popularly called ‘Batra’. The auto will take 10 rupee for batra.
There are also some important place near by Mukherjee nagar. You you wish to reach New Delhi railways station, Cannaut place, India gate, Quotub minar, Lal quila, Delhi gate, chandani chauk, kashmir gate and many more then you will get direct convene.
There is one thing which is missing in Mukherjee nagar is means of intertainment. All India Institute of Medical Sciences (AIIMS) will issue an Admit Card for the MBBS Entrepreneurship Examination today. You can download your Admit Card Official Website by visiting aiimsexams.org.

Anu's studies from 12th Century are from Sonipat's school. Anu has been a student of Physics Honors of Hindu College of Delhi University.

Anu has also done an MBA from IMT Nagpur. Anu was working in a private insurance company in Gurgaon for the past 9 years, but left job for two years before preparing for the exam. Anu explains that he had already given pre-examination of UPSC, but at that time only the examination method was seen. Now I gave the exam with full preparation.

Anu explains that the job was good, but I was not getting any satisfaction from inside. I wanted to do something for the people, so I decided to complete the dream of clearing the UPSAC.
